Electric Scooter Rental Agreement and General Conditions


Chapter 1 - Purpose of the Service

Art.1 - These conditions govern the rental of all-terrain electric scooters, related equipment, and protective helmets, hereinafter referred to as "the rented goods," by the individual, Trotti’Nature, hereinafter referred to as "the lessor."


Art.2 - By signing, the person renting the scooter and its related accessories, hereinafter referred to as "the lessee," declares to have read these conditions and accepts them unconditionally. Should these conditions not be adhered to, the lessor reserves the right to refuse any additional rentals to the lessee.


Art.3 - The rental of a scooter and its accessories becomes effective at the moment the lessee takes possession of the equipment; at this moment, all associated risks are transferred to the lessee, who will assume full responsibility for the custody of the borrowed equipment. The contract ends upon the complete return of the rented goods, in accordance with the details specified below.


Chapter 2 - The Lessee

Art.4 - The lessee declares to be capable of operating the scooters, being unaware of any medical contraindications, and expressly waives any liability of the lessor in this regard. The lessor reserves the right to assess the lessee's ability to use the rented goods within this service and to deny access to the service if the lessee is deemed incapable or unfit.


Art.5 - The lessee must be an individual older than 18 years. For minors under 18 years old, access to the service is only available if authorized by their legal guardian. Children and youths under 16 must be accompanied by an adult who will assume the role of lessee. Parents or legal guardians of any minor are held responsible for any damage directly or indirectly caused by the minor while using the service.


Chapter 3 - Terms of the Rental Service


Art.6 - The rental service is available at the fixed starting point of Trotti’Nature or any other agreed-upon location between the lessor and the lessee, during the usual opening hours, which are displayed on the lessor's website and are available upon request.


Art.7 - The applicable rates are displayed in the lessor's premises and are available upon request.


Art.8 - At the time of signing the contract, the lessee is required to present a valid identification document. The rental price is payable in cash or by bank transfer before taking over the rented goods. Payment by credit card or check is not accepted.


Art.9 - The lessor retains the right to pursue the lessee to obtain full compensation for any damages incurred.


Chapter 4 - Provision and Return of Equipment


Art.10 - The provision and acceptance of the rented goods occur at the lessor's starting point or any other agreed-upon location.

The lessee is responsible for the good working condition, cleanliness, and battery charge of the rented goods. This condition is verified in the presence of the lessee, who may make any remarks in the rental contract. If there is a failure of the rented goods or the battery runs out during the rental, the lessee cannot claim any damages.


Art.11 - The return of the rented goods takes place on the agreed date and time, at the starting point of the lessor or any other agreed-upon location. An oral agreement on the condition of the rented goods is made between the parties at the time of return. In the event of early return, the lessee is not entitled to any refund.


Art.12 - Extension of the rental contract is made upon the express request of the lessee to the lessor and must be done before the end of the rental period.


Art.13 - If the lessee keeps the rented goods beyond the agreed period without having regularized their situation and/or does not return the rented goods during the lessor's reception hours, they lose the benefits of the guarantees provided in the contract and remain responsible until the rented goods are returned to the lessor. Any return of the equipment after the agreed time results in a flat-rate penalty, the amount of which is set in the current price list.


Chapter 5 - The Rented Goods

Art.14 - Wearing a helmet is mandatory. The lessee acknowledges that the lessor has provided as many helmets as there are users.

Each scooter is equipped with:

-a 1500W motor (range of 25 to 40 Km)

-a small LED screen displaying the selected power level and speed, which must be below 25Km/h;


Art.15 - The lessee agrees to use the rented goods carefully, as a "good father," including:

returning the rented goods at the end of the rental period on the scheduled dates, times, and locations, in the condition they were received, except for normal wear and tear;

circulating on public roads with caution, without endangering others, and in compliance with the traffic regulations in force;

taking all necessary precautions to avoid damage, accidents, loss, or theft of the rented goods;

not to use the scooters beyond their capacities, specifically limiting the use to 110 Kgs and to one person at a time.



Art.16 - Lessees ride at their own risk. If during the rental, the lessee violates any laws and regulations, the lessor cannot be held responsible.

The lessor disclaims any liability in case of non-use or improper use of the rented goods by the lessee or made available to them.


Art.17 - The lessee is prohibited from lending, subleasing, or transferring the rented goods to a third party for the duration of the rental without the express consent of the lessor, who remains the exclusive owner.


Chapter 6 - Responsibilities


Art.18 - The lessee states that they have personal liability insurance that covers them during the use of the rented goods, both for themselves and for people for whom they are responsible.

Art.19 - From the moment the lessee takes possession of the rented goods, they become civilly responsible. By signing the rental contract, the lessee releases the lessor from any responsibility in case of accidents of any nature, bodily, material, or immaterial damages caused to third parties, to themselves, and to any goods possibly transported, arising from the use of the rented goods, whether they are the perpetrator or user.

The lessee undertakes to obtain a waiver from their insurers against the lessor for the aforementioned damages.


Art.20 - In the event that the rented goods are damaged, lost, or stolen during the rental, the lessor reserves the right to claim compensation from the lessee, the amount of which is set in the applicable price list.


Art.21 - The lessee is responsible for all damages to the rented goods resulting from falls, acts of vandalism, natural factors, handling, issues related to transportation, and inappropriate or misused use of the rented goods. In case of breakage, failure, vandalism, or accident, the lessee must immediately notify the lessor. The lessee is obliged to return the rented goods to the starting point and to return all the damaged equipment. Damages are billed according to the current rates. The lessee cannot undertake any repair work without the prior consent of the lessor.

Under no circumstances can the lessee claim damages during the rental. However, the lessee cannot be held responsible for the damaging consequences of hidden defects of the rented goods or non-apparent wear inappropriate for the intended use, provided that proof of such defects or wear can be provided by the lessee.


Art.22 - In case of theft, the lessee must immediately contact the lessor, file a complaint with the competent authorities within 24 hours, and provide the lessor with a photocopy of the complaint filing.

In cases of theft by the lessee, misappropriation, or any damage resulting from non-compliance with the usage rules, regulations in force, or the terms of this contract, the lessor is entitled to seek recourse for the total prejudice.


Chapter 7 - Confidentiality and Use of Personal Data

Art.23 - Personal data is processed in accordance with legal provisions relating to the processing of personal data. They are collected for the operation of the service.

They may not be disclosed to third parties nor used for commercial purposes. Any user can request access to and, if necessary, correction of the information concerning them.

Chapter 8 - Dispute Resolution

Art.24 - These conditions are governed by Belgian law. Any dispute relating to their execution and consequences is subject to the courts and tribunals of the judicial district of Flemish Brabant.
